The Campus Sexual Violence Elimination (SaVE) Act is a provision of the Violence Against
Women Reauthorization Act of 2013 (VAWA) that aims to address campus sexual violence,
domestic violence, dating violence, and stalking. It amends the Jeanne Clery Disclosure
of Campus Security Policy and Campus Crime Statistics Act (Clery Act) and enhances
protections for victims of sexual violence on college campuses.
Key Provisions of the Campus SaVE Act:
Crime Statistics:TSU must include statistics on incidents of domestic violence, dating violence, sexual
assault, and stalking in its Annual Security Report (ASR).
Geographic Scope:The requirement covers incidents occurring on campus, on public property within or
immediately adjacent to the campus, and in or on non-campus buildings or property
that TSU owns or controls.
Awareness and Prevention Programs:TSU has implemented primary prevention and awareness programs for all incoming students
and new employees, including information on risk reduction, bystander intervention,
and the TSU’s policies and procedures.
Written Policies:TSU has a written policy for handling cases of domestic violence, dating violence,
sexual assault, and stalking. This includes a clear statement of TSU’s disciplinary
procedures and the rights of the victims and the accused.
Victim Rights:Campus SaVE ensures that victims are informed of their rights and options, including:
The right to report the incident to law enforcement and receive assistance from campus
authorities in notifying law enforcement.
The right to obtain or enforce a no-contact directive or restraining order.
The right to change academic, living, transportation, and working situations to avoid
a hostile environment.
Confidentiality:TSU will protect, to the extent possible under state and federal law, the confidentiality
of victims, including how publicly available record-keeping will be handled to ensure
confidentiality.
Prompt and Fair Process:Under TSU’s Title IX policy, a fair, prompt, and impartial investigative process will
provide the following:
The opportunity for both parties to present witnesses and evidence.
Ensuring that officials handling these cases receive annual training on issues related
to domestic violence, dating violence, sexual assault, and stalking, and how to conduct
an investigation and hearing process that protects the safety of victims and promotes
accountability.
Providing both parties with the same opportunities to have others present during a
disciplinary proceeding, including an advisor of their choice.
Simultaneous Notification:As is outlined in Title IX, both the Complainant and the Respondent must be informed
simultaneously and in writing of the outcome of any institutional disciplinary proceeding,
TSU’s procedures for appealing the results, any change to the results, and when such
results become final.
